- il 16 Marzo 2004 da un altro Giudice di Pace di Lodi, con la sentenza n.256/04, R.G. 1033/03 ha totalmente condiviso la tesi del difensore in cui, per un caso di intervento in una piazzola di sosta adiacente alla corsia di emergenza ha sentenziato: “La fattispecie dedotta nel ricorso e in fatto, non contestata in modo convincente appare a questo Giudice non rientrante nell’applicazione dell’art.175 CdS il quale richiama l’art.159 e quindi gli art. 157 e 158 CdS. Il xxxxxxxxxx esercita professionalmente l’attività di soccorso automobilistico, come da certificazione prodotta, e pertanto resta escluso che l’intervento, oggetto di accertamento, abbia costituito ostacolo e pregiudizio per la sicurezza stradale. Poiché il caso in esame non è vietato e sanzionabile dalla legge, Questo Giudice dichiara illegittimo il procedimento sanzionatorio.”

COMPORTAMENTO PER IL SOCCORRITORE IN CASO DI INFRAZIONE ALL’ART.175 CdS
Se, durante un soccorso stradale in autostrada effettuato senza autorizzazione la polizia intervenuta ordina al soccorritore di cessare l’attività o meglio di abbandonare o scaricare il veicolo, si deve invitare l’agente a scrivere sul verbale di infrazione i motivi del suo comportamento e la norma che lo prevede.
Se l’agente si oppone, allora potete proseguire nella vostra azione di recupero del veicolo.
Infatti, alla violazione dell’art.175 comma 12 e 16 non vi è alcuna conseguente sanzione accessoria. E’ sufficiente leggere l’art.212 del CdS per comprendere che solo: nell’ipotesi in cui le norme del codice dispongono che da una violazione consegua la sanzione accessoria dell’obbligo di sospendere o di cessare da una determinata attività, l’agente accertatore ne fa menzione nel verbale di contestazione, e quindi ha titolo perché si ottemperi.
A questo punto si deve invitare l’agente a verificare il”prontuario” delle infrazioni e solo se queste lo prevedono, allora è giusto obbedire alla cessazione dell’effettuazione del soccorso.
Inoltre, sempre per infrazione dell’art.175 comma 12 non è prevista nemmeno il ritiro della patente o il sequestro del mezzo, mentre l’automobilista non subisce alcunché.
L’agente, se vuole, deve limitarsi alla compilazione del verbale di infrazione senza” minacce “di alcun genere od altro, recependo inoltre le dichiarazioni del trasgressore, ossia del soccorritore
