COMUNICATO
DECRETO ATTUATIVO (nuova ALIENAZIONE STARORDINARIA) del Capo del Dipartimento Affari interni e territoriali di concerto con il Direttore dell’Agenzia del Demanio recante “individuazione delle modalità di svolgimento dell’alienazione e delle attività ad essere funzionali e connesse di cui all’art. 1, comma 447 della legge 27.12.2013 n. 147”
EPPURE QUALCUNO E’ CONTENTO ? !
Di seguito Vi riportiamo l’interrogazione che la nostra Associazione in data11/09/2014 ore 08.31.47ha sottoposto al Ministero degli Interni Dipartimento Affari Interni e Territoriali e all’Agenzia del Demanio.
Con la presente, alla luce della presa visione dello schema di decreto in oggetto, così come, consultabile dalla Conferenza Stato Città ed Autonomie Locali che ha espresso parere favorevole nella seduta del 05.08.2014, nella veste di Associazione di Categoria dei Soccorritori Stradali e Custodi Giudiziari, siamo a chiedere alle signorie loro l’interpretazione autentica del predetto decreto al fine di ricevere conferma della applicazione delle ordinarie tariffe di recupero e custodia concordate, censite ed applicate dalle Prefetture/U.T.G. sulla base dei Decreti Annuali di individuazione dei custodi espletanti il servizio di sequestro amministrativo ai sensi del D.p.R. 571/1982.
Dalla lettura del predetto schema di decreto risulterebbe al contrario, in palese contrasto con il disposto di cui all’art. 1 comma 444 e seguenti legge 147 del 2013 e in palese contrasto con i predetti decreti Prefettizi che sia intendimento della Pubblica Amministrazione applicare la Circolare n. 38 protocollo 6626 del 04.04.2000 del Ministero dell’Interno Direzione Generale per l’Amministrazione Generale che per gli affari del personale avente ad oggetto “ Veicoli sequestrati ai sensi del codice della strada. Requisiti incaricati della custodia. Determinazione delle spese di custodia” e dunque individuare tariffe di fatto mai applicate, abrogate da normative e disposizioni successive ed unilateralmente individuate sulla base, appunto, di una Circolare con efficacia meramente interna.
Auspicando un Vostro pronto ed esaustivo intervento delucidativi, si comunica sin da ora che nel caso in cui il decreto fosse comunque pubblicato nella predetta versione e non si conseguissero entro 10 giorni dalla pubblicazione del medesimo, idonee garanzie formali per la non applicazione delle tariffe di cui alla Circolare n. 38 prot 6626 del 04.04.2000 questa Associazione, come ha già dato prova per il procedimento che ha dato esito alla Sentenza della Corte Costituzionale n. 92/2013 agirà nelle competenti sedi per la tutela dei diritti dei propri associati.
Anche alla luce delle previsioni di cui all’art. 4 comma 1 lettera b) (riduzione annua del 20% infondata ma purtroppo alquanto probabile) e c) (riduzione annua del 40%), qualora appunto il decreto venisse pubblicato così come nello schema approvato dalla Conferenza Stato – città ed autonomie locali, sconsigliamo gli associati ad aderire a tale nuova forma di alienazione straordinaria.

Nuove procedure per l’applicazione della misura cautelare del sequestro amministrativo e della sanzione accessoria del fermo amministrativo del veicolo.
Ribadiamo la posizione della nostra associazione in merito al Custode Acquirente sostenendo ancora una volta che, purtroppo, le cose non potranno che andare peggio.
Abbiamo sempre ripetuto che ci si doveva astenere dal partecipare alle gare d’appalto per l’individuazione dei custodi acquirenti pena il dividere ancora una volta la categoria, il progressivo svilimento della qualificazione professionale e l’immiserimento delle nostre società.
La predetta circolare non è che un ‘ulteriore tappa di questa caduta senza fine, così come hanno dimostrato i ribassi epocali applicati dalle società offerenti nelle ultime pubbliche gare.
Detto ciò al fine di una maggiore tutela della categoria l’A.S.S.I. proclama lo stato di agitazione e suggerisce a tutti i soccorritori e custodi giudiziari di astenersi da tutti gli interventi non obbligatori ai sensi di legge o di contratto, garantendo solo ed esclusivamente lo spostamento (non presa in custodia) dei veicoli per intralcio alla circolazione.
