Il sequestro dell’auto è solo “virtuale”
per la guida in stato di ebbrezza era assodato che ad oggi superata la fatidica soglia del 1,5 si perdeva il proprio veicolo confiscato e venduto all’asta ma primo caso in Italia!!!
La notizia a dell’incredibile d’ora in avanti a Genova gli autoveicoli fermati a seguito di guida in stato di ebbrezza in attesa di confisca non saranno più dati in custodia ai depositi giudiziari ma diventano a tutti gli effetti “virtuali”. Ovvero:gli autoveicoli sono formalmente di proprietà dell’amministrazione pubblica e non possono essere ceduti; ma materialmente restano in custodia a chi se l’è fatte sequestrare e in attesa dei lunghi tempi dei processi e paradossale le può pure guidare se e quando gli ridaranno la patente il tutto a seguito di una circolare del procuratore capo Francesco Lalla che per evitare di far anticipare le spese di custodia a carico della giustizia e poi del proprietario è sufficiente una comunicazione del provvedimento da parte della polizia Stradale o carabinieri per esempio – al Pra e lo stesso proprietario ne sarà il custode

Guidare ubriachi costa il sequestro dell’auto in leasing
L’auto condotta in stato di ebbrezza può essere sequestrata – in vista della confisca – anche se è in leasing, e quindi non appartiene al guidatore. La quarta sezione penale della Cassazione (sentenza 10688/2010) allarga il perimetro della confisca come sanzione ulteriormente afflittiva per chi è sorpreso ubriaco al volante, confermando lo spossessamento di una Audi Q7 fermata a un controllo stradale il 10 giugno scorso a Fermo. I giudici di merito non avevano avuto dubbi nel disporre e poi mantenere il sequestro preventivo: alla decisione del Gip si era associato qualche settimana dopo lo stesso Riesame, che aveva respinto la tesi difensiva secondo cui il veicolo era intestato a terzi (la società di leasing, appunto), e che il periculum in mora (cioè il rischio di nuove violazioni all’articolo 186 del Codice della strada) sarebbe stato neutralizzato dalla sospensione della patente del guidatore.
La Cassazione, nei motivi sintetici per respingere l’ulteriore impugnazione, ha sottolineato che il bene detenuto in forza del contratto di leasing «appartiene al soggetto al quale è stata attribuita la materiale disponibilità del bene stesso; e anche se non è «proprietà», questo stato le somiglia molto perché è di fatto un «diritto a godere (del bene, ndr) sulla base di un titolo che esclude i terzi». Pertanto, «appare evidente la legittimità del sequestro di un veicolo il cui conducente sorpreso alla guida in stato di ebbrezza (…) ne abbia la disponibilità in forza di un contratto di leasing». Lo stesso periculum in mora di reiterazione può essere garantito solo dal sequestro, atteso che la sospensione della patente è un provvedimento, per sua natura, temporaneo. Quanto ai diritti della società di leasing, l’auto deve essere dissequestrata solo di fronte alla dimostrazione della cessazione del contratto di locazione finanziaria.
La sentenza di ieri quindi conferma una linea di rigore nell’applicare la confisca del veicolo, introdotta dal pacchetto sicurezza del 2008 (Dl 92/08) per i casi più gravi di ebbrezza (articolo 186 del Codice della strada) e per la guida sotto l’effetto di stupefacenti (articolo 187). La confisca crea una serie di problemi visto che, per principio generale, non può scattare quando la circolazione del veicolo avviene contro la volontà del proprietario o quando questi è comunque estraneo all’infrazione, che accade quando il mezzo è intestato a soggetto diverso dal conducente. È il caso non solo di leasing e noleggio, ma anche della cointestazione. Sotto questo profilo, si sono lette sentenze molto garantiste, come quella che un anno fa a Bologna escluse la confiscabilità solo perché il trasgressore era in comunione di beni con la moglie (in questo caso, la comproprietà esiste per legge). Ma la Cassazione pare aver ormai adottato una linea ben più restrittiva. Lo si è visto a partire dalla sentenza 45938 del 1° dicembre 2009: secondo la quarta sezione penale, per non far scattare la confisca occorre che il veicolo sia integralmente intestato a un terzo estraneo, perché la cointestazione lascerebbe presumere che il trasgressore utilizzi il mezzo non solo occasionalmente, e quindi se ne conservasse la disponibilità potrebbe utilizzarlo ancora in modo da costituire pericolo.

L’intenzione era lodevole: inasprire pene e sanzioni per chi guida ubriaco mettendo a rischio la vita degli altri. Ma la nuova norma del Codice della strada, l’art. 186, è scritta male e può essere interpretata in modo differente. In sostanza, il paradosso è che basta sottrarsi all’alcoltest per evitare la confisca della vettura. La Corte di Cassazione (stessa sezione, la IV) ha dato due interpretazioni diverse del comma 2 e del comma 7 dell’art. 186, e adesso dovrà riunirsi a sezioni unite – l’udienza è fissata il 25 febbraio prossimo – per sciogliere la matassa.
Da ultimo, a sollevare il caso davanti al Tribunale di Macerata, che gli ha dato ragione, è stato l’avvocato Giampaolo Cicconi, difensore di un uomo, Fernando O., sorpreso il 23 dicembre scorso dai carabinieri a guidare ubriaco la Fiat Punto della compagna Rosella Z., lungo la Statale 256 a Matelica.
Il conducente si era rifiutato di sottoporsi all’etilometro (con successivo procedimento penale e ritiro della patente), ma il Tribunale maceratese ha disposto la restituzione della vettura, confiscata con la convalida del Gip, alla proprietaria. Una decisione adottata in forza all’ordinanza n. 44640 del 27 ottobre 2009 della Cassazione, secondo la quale se un soggetto non vuole rischiare il sequestro immediato dell’automezzo basta che eviti l’alocoltest. La confisca infatti è considerata una sanzione amministrativa accessoria, e non misura di sicurezza patrimoniale.
Ma cinque mesi prima, il 13 maggio 2009, la stessa quarta sezione aveva firmato un’ordinanza di contenuto opposto, che sancisce la confisca penale del veicolo per chi si rifiuta di sottoporsi al test. La sentenza n. 3745/09 aveva confermato che per accertare questo reato non era necessario il test dell’etilometro: quando gli agenti hanno già abbastanza elementi per capire se si è ubriachi (alito, barcollamenti eccetera) e li descrivono bene nel verbale, c’è comunque la prova che il guidatore è ebbro. Dunque, le sanzioni si sommano. E, secondo questa prima interpretazione della Cassazione, si perderebbero definitivamente veicolo e patente: il rifiuto comporta la confisca del mezzo, mentre entrambe le violazioni fanno sottrarre 10 punti ciascuna, per cui in un sol colpo si arriva a esaurire i 20 punti a disposizione, con la necessità di rifare gli esami. Ci si potrebbe salvare solo se per “buona condotta” avendo ottenuto gli extra-bonus che fanno salire la dote di due punti ogni biennio, fino a un massimo di 30.
Il Tribunale di Macerata (presidente Alessandro Iacoboni) stavolta ha fatto proprie le argomentazioni di Cicconi e le previsioni dell’ordinanza di ottobre, pur in attesa del pronunciamento delle sezioni unite della Cassazione.
